In response to the significant decrease in transport services caused by the Covid 19 epidemiological emergency, also in light of the regulation issued by the relevant institutional bodies to contain the spread of the virus, we have adopted various measures for railway undertakings in addition to those of the relevant institutional bodies supporting the railway sector.

We provide an account of this below, together with some clarification on applying the procedures set out in the NS which we deem useful to note with regard to the possible impact that they may have on the operations of railway undertakings.

The same information has been sent in a notice from RFI to all railway undertakings and Framework Agreement holders.

Administrative and accounting impacts

On 17 April 2020 (ref. RFI.DCO\PEC\P\2020\0000527), RFI announced, with effect from March 2020, the partial revision of the administrative and accounting procedures contained in the NS, specifically in section 6.7, governing relations with all our Clients.
Subsequently, on 28 Aprile 2021, RFI announced (prot. RFI.DCO\PEC\P\2021\0001036) an integration of these measures for the months from May to July 2021, in continuity with what has already been done in 2020 and the first four months of 2021, as indicated below:

 Toll

  • Failure to issue a Down Payment Invoice equal to 85% of the contract value (Financial Annex to the Usage Contract);
  • Issue of an advance invoice (monthly instalment for the month in question) equal to 85% of the value - finalised by the PIC system - by the end of the month following the month in question.

 

Traction Electricity

  • Failure to issue a Down Payment Invoice equal to 85% of the contract value (Financial Annex to the Usage Contract);
  • Issue of an advance invoice (monthly instalment for the month in question) equal to 85% of the value - finalised by the PIC system - by the end of the month following the month in question.

 

 Balance

Issue of a quarterly adjustment invoice - by the 30th day of the second month following the relevant quarter - resulting from the difference between the final amount and the amount on account relating to tolls and electricity.

RFI will proceed with the above billing procedures until 31 July 2021.

Penalties for failure to use contractually-agreed paths

Consistent with the provisions of the regulatory framework and in continuity with what has already been done during 2020 and the first four months of 2021, this Manager will not apply the penalties set out in section 4.6.3 of the NS for the cancellations notified by RUs until 31 July 2021.

It should also be noted that, in view of the effects that the continuation of the current pandemic scenario may have on the reshaping of rail services during the current timetable, the abolition of traffic planned after 31 July will be considered excluded from the accounting of penalties if requested by that date.
