Regulation concering access to platforms ar Milano Centrale, Fireze Santa Maria Novella, Roma Termini e Napoli Centrale stations

With regards to:

Article 26 of Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers’ rights and obligations, stating: “In agreement with public authorities, railway undertakings, infrastructure managers and station managers shall take adequate measures in their respective fields of responsibility and adapt them to the level of security defined by the public authorities to ensure passengers’ personal security in railway stations and on trains and to manage risks. They shall cooperate and exchange information on best practices concerning the prevention of acts, which are likely to deteriorate the level of security”;

Article 17.1 of DPR no. 735/1980, stating: “Chiunque si serve delle ferrovie deve osservare tutte le prescrizioni relative all’uso delle medesime ed è tenuto in ogni caso ad attenersi alle avvertenze, inviti e disposizioni delle aziende esercenti e del personale per quanto concerne la regolarità amministrativa e funzionale, nonché l’ordine e la sicurezza dell’esercizio”;

Article 20.1 of DPR no. 735/1980, stating: “Le aziende esercenti determinano le aree, gli impianti e i locali aperti al pubblico nei quali l’accesso e la sosta delle persone, nonché la circolazione e sosta dei veicoli stradali, hanno luogo in base a quanto previsto dalle predette aziende”;

Article 23.1 of DPR no. 735/1980, stating: “I viaggiatori devono prendere posto nei treni o veicoli già muniti di regolare biglietto o altro valido titolo di viaggio, […]”;

Article 24.1 of DPR no. 735/1980, stating: “I biglietti o gli altri recapiti di viaggio non possono essere usati in modo diverso da quello stabilito dalle rispettive norme di utilizzazione […]”;

Article 30.1 and 30.2 of DPR no. 735/1980, stating: “È fatto divieto alle persone non espressamente autorizzate dalle aziende esercenti di svolgere sui treni e veicoli, nonché nelle stazioni e fermate, l'attività di venditore di beni o di servizi. È fatto altresì divieto di svolgere attività di cantante, suonatore e simili, e di fare raccolta di fondi a qualunque titolo”;

Article 31.1 of DPR no. 735/1980, stating: “Possono essere escluse dai treni e dai veicoli e allontanate dalle stazioni e dalle fermate le persone che si trovino in stato di ubriachezza, che offendano la decenza o diano scandalo o disturbo agli altri viaggiatori e che ricusino di ottemperare alle prescrizioni d'ordine o di sicurezza del servizio”.

The following regulations are adopted:

A- The railway stations, as per the list available online at: https://www.rfi.it/en/stations/quality-services/Gates-and-video-surveillance.html are divided into two separate areas by specifically marked infrastructural boundaries:

  • Commercial area (i.e. “area di I livello”). Without any prejudice to all the applicable regulations, including DPR 753/1980, access to this area is not subject to the possession of any authorization or travel document;
  • Railway operational area (i.e. “area di II livello”), located in proximity of the train platforms and delimited by infrastructural boundaries. Access to this area is only granted to authorized passengers, personnel and vehicles, upon presentation of a valid travel document or other suitable entitlements. Infrastructure Manager’s staff at entrance gates/turnstiles, qualified as public officers/public service providers (i.e. “Pubblico Ufficiale”, “Incaricato di pubblico servizio”), are responsible for verifying travel documents and other entitlements validity.

B- Passengers in possession of a valid travel document - duly stamped when required - suitable for the departure or interchange stations (without prejudice to specific cases referred to single Railway Undertakings) are allowed inside the railway operational area. Passengers may access the railway operational area within 40 minutes ahead their train departure time (as indicated on the travel ticket). In any case, passengers are not allowed to stay inside the railway operational area for more than 40 minutes ahead the scheduled departure time, except in case of delays.

In case of checks, passengers found to be staying inside the railway operational area for more than 40 minutes will be accompanied outside by Infrastructure Manager’s staff with the concourse - if necessary - of Railway Police agents, unless their train departure is imminent.

C- Passengers shall conform to the prescriptions made by railway companies and behave at all times with decency and in such a way not to endanger themselves or others, or to damage any premises or goods. In order to ensure the regularity of the inflow/outflow of passengers, any dilatory or obstructive behaviour affecting ticket verification operations is prohibited.

D- For security reasons, the Infrastructure Manager may - at any time - close or restrict the access to the railway operational area.

E- Checks carried out by Infrastructure Manager’s staff at access gates/turnstiles - which do not replace those carried out on board the trains by Railway Companies’ staff – may be repeated at any time within the railway operational area. Passengers standing inside the aforementioned area without being authorised – and, in any case, without an objective reason – may incur a penalty fare and be accompanied outside by Infrastructure Manager’s staff with the concourse - if necessary - of Railway Police Agents.

F- In order to facilitate the flows at entrance gates, travellers shall present - when required by security staff - their travel document or other entitlement, properly validated and accompanied by a valid identity document if necessary. In order to allow the verification operations, travellers shall present themselves in due time before the train departure. Personnel in charge of controls may refuse access to the railway operational area to those passengers (even in possession of a valid travel document) whose conduct may affect safety, offend decency or disturb other travellers, and in case of non-compliance with any instructions or prescriptions given. In such cases, railway staff in charge of controls cannot be held responsible for the missed journey or for any other related loss or prejudice.

F-bis- At stations where automated turnstiles are in operation, travellers shall queue behind the marked waiting line, presenting their travel document and accessing the railway operational area one at a time. Once inside the railway operational area, passengers will not be able to use the same travel document to access again through the turnstiles. Therefore, passengers needing to temporarily leave the railway operational area shall first address the staff in charge of controls who will, unquestionably, evaluate the possibility of granting further access in case of urgency and necessity (as an example, for reaching restrooms or assistance services).

G- It is mandatory for passengers to keep their travel document for the entire period of stay inside the station and, in any case, until they definitively leave the railway operational area.

H- Accompanying persons are not allowed inside the railway operational area, except for those assisting passengers with reduced mobility. Exceptions to this rule, motivated by exceptional and specific needs (as an example, for underage or elder travellers) may be unquestionably evaluated and authorized by the personnel in charge of access controls.

I- Unless otherwise provided by Public Security or Judicial Authorities, law enforcement personnel are authorized to access the railway operational area for service reasons upon presentation of a valid means of identification.

J- Without any prejudice to the previous statements, access of animals to the railway operational area is ruled by DPR no. 753/1980 and by every other applicable railway regulation, except for guide dogs assisting travellers with reduced mobility.

K- Passengers must walk bicycles, scooters and any electrically or manually-powered vehicles while inside both Commercial Area and Railway Operational Area; while carrying a vehicle, passengers are required to possess an additional valid ticket for accessing the Railway Operational Area as provided by applicable railway regulations. It is forbidden to leave vehicles outside the dedicated parking areas. 

L- A paper copy of the present regulation is affixed inside all the stations included on the list published online on the Rete Ferroviaria Italiana S.p.A. (https://www.rfi.it/en/stations/quality-services/Gates-and-video-surveillance.html) and Grandi Stazioni Rail S.p.A. official websites.

M- For all legal purposes, the Italian version of the present regulation shall be considered as the only official and valid reference.

PENALTIES

Transgressors infringing the rules stated in the present regulation will be subject – without any prejudice to the provisions of DPR no. 753/1980 – to administrative penalties ranging from a minimum of 20,00 (twenty) to a maximum of 50,00 (fifty) euros (article no. 17, DPR 753/1980; amounts updated as per article 3, Law no. 94 of 15 July 2009). When applicable, transgressors will be subject to criminal complaints as provided by criminal laws.
